Terms and Conditions

The EMS Atlas ("EMS Atlas," "we," "us," or "our"), is an online directory designed to connect individuals seeking Whole-Body Electrical Muscle Stimulation ("WB-EMS") training with independent EMS trainers, studios, and fitness professionals worldwide.

The EMS Atlas website and related services (collectively, the "Platform") are operated by the EMS Atlas, located in California, USA.

By accessing the Platform, creating an account, submitting a professional listing, or otherwise using our services, you agree to these Terms and Conditions ("Terms"). If you do not agree, you must not use the Platform.

EMS Atlas is an informational directory and connection platform that helps consumers discover independent WB-EMS trainers, studios, and service providers.

EMS Atlas does not itself provide personal training, EMS sessions, medical treatment, rehabilitation, or other fitness services.

Unless expressly stated otherwise, EMS Atlas does not employ, supervise, manage, certify, license, or endorse the independent professionals listed on the Platform.

Any training services, appointments, payments, cancellations, refunds, or other arrangements are made directly between consumers and the respective service providers.

To register as an EMS professional, you must:

• Be at least 18 years old or the age of legal majority in your jurisdiction, whichever is greater.
• Provide accurate, current, and complete registration information.
• Have the legal authority to represent the trainer, studio, or business being listed.
• Comply with applicable laws, professional requirements, and industry standards.
• Maintain the confidentiality of your login credentials.

You are responsible for activities conducted through your account, except to the extent caused by EMS Atlas's own actions or failures.

You must notify EMS Atlas promptly if you suspect unauthorized access to your account.

By submitting a listing, you represent and warrant that:

1. All information provided is truthful, accurate, and current.
2. Any professional certifications, qualifications, experience, and credentials listed are genuine and accurately represented.
3. You possess any licenses, registrations, permits, insurance, or other authorizations required to lawfully provide your services in your jurisdiction.
4. You have the necessary training, competence, and authorization to operate the EMS equipment and provide the services advertised.
5. You have permission to use all photographs, logos, business names, descriptions, and other submitted content.
6. Your listing does not contain false, misleading, deceptive, discriminatory, defamatory, or unlawful information.
7. You will promptly update information that becomes inaccurate or outdated.

EMS Atlas reserves the right to request supporting information concerning credentials, business ownership, or other listing claims.

Publication of a listing does not constitute independent verification or endorsement of the professional's qualifications.

All professional listings are subject to administrative review.

EMS Atlas may, in its reasonable discretion and consistent with applicable law:

• Approve or decline a listing.
• Request corrections or additional information.
• Review material changes to existing listings.
• Temporarily suspend a listing.
• Remove listings that violate these Terms.
• Restrict access to the Platform where necessary to protect users, security, or the integrity of the directory.

Submitting a listing does not guarantee acceptance, publication, search placement, continued availability, or any particular level of exposure.

EMS Atlas may distinguish between published information and proposed updates awaiting review.

All trainers, studios, and service providers listed on EMS Atlas operate independently of EMS Atlas unless expressly identified otherwise.

Each professional is solely responsible for their own:

• Training programs and services.
• Client screening and informed consent.
• Assessment of medical or physical contraindications.
• Safe and appropriate use of EMS equipment.
• Professional qualifications and required certifications.
• Compliance with applicable laws and safety standards.
• Business insurance and professional liability coverage.
• Scheduling, pricing, payments, cancellations, and refunds.
• Client communications and customer service.
• Injuries, damages, claims, or disputes arising from their own services, subject to applicable law.

EMS Atlas does not establish an employment, agency, partnership, franchise, or joint-venture relationship with listed professionals merely by providing a directory listing.

Professionals may not represent themselves as employees, agents, or officially certified representatives of EMS Atlas without written authorization.

Whole-Body Electrical Muscle Stimulation involves the application of electrical impulses to stimulate muscle contractions.

WB-EMS may not be appropriate for every individual. Certain medical conditions, implanted devices, health circumstances, or other contraindications may make EMS training unsuitable or require additional precautions.

EMS Atlas does not provide medical advice, medical screening, diagnosis, treatment, or individualized exercise prescriptions.

Information on the Platform is provided for general informational purposes and is not a substitute for professional medical advice.

Consumers should consult an appropriately qualified healthcare professional when indicated before beginning EMS training.

Each independent EMS professional is responsible for screening clients, identifying contraindications, obtaining appropriate informed consent, and conducting sessions in accordance with applicable professional and safety standards.

Consumers using EMS Atlas acknowledge that:

• Listings are supplied by independent third parties.
• EMS Atlas does not guarantee the qualifications, competence, safety, availability, or performance of any listed provider.
• Consumers should independently evaluate trainers and studios before purchasing services.
• Any training agreement is between the consumer and the independent provider.
• Prices, availability, services, and policies may change without notice.

Consumers should verify relevant qualifications, experience, insurance, and other information directly with a provider.

EMS Atlas does not guarantee:

• That consumers will achieve specific health, fitness, or training results.
• That listed professionals will receive inquiries, appointments, clients, or revenue.
• That listings will appear in a particular search position.
• That directory information will always be complete, accurate, or current.
• Uninterrupted or error-free operation of the Platform.

Search placement may depend on location, relevance, availability of information, and other directory criteria.

If sponsored or paid placements are introduced, material advertising relationships will be identified as required by applicable law.

Professionals retain ownership of content they lawfully submit to EMS Atlas.

By submitting content, you grant EMS Atlas a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, and use that content as reasonably necessary to operate, maintain, and promote your listing and the Platform.

This license includes displaying submitted information in directory search results, individual profile pages, and promotional materials featuring your listing, subject to applicable privacy and other laws.

You represent that you have the rights necessary to grant this license.

The license ends when the relevant content is removed, except where continued retention or use is reasonably necessary for legal compliance, security, backups, or other lawful purposes.

EMS Atlas retains ownership of its website design, branding, software, original content, logos, and other proprietary materials, excluding content owned by third parties.

Users may not:

• Submit false or misleading business information.
• Impersonate another person or business.
• Misrepresent professional qualifications or certifications.
• Publish deceptive or unsupported medical or fitness claims.
• Upload content that infringes another party's rights.
• Use the Platform for fraud, harassment, discrimination, or unlawful activity.
• Attempt to bypass listing approval procedures.
• Access or modify another user's account or private information without authorization.
• Interfere with website security or functionality.
• Introduce malicious software or conduct unauthorized vulnerability testing.
• Harvest personal information for spam or unauthorized marketing.
• Use automated scraping or extraction tools in violation of these Terms or applicable law.

EMS Atlas may investigate suspected violations and take appropriate action.

Listings may contain links to independent websites, booking platforms, social media accounts, and other external services.

EMS Atlas does not control these third-party services and is not responsible for their content, availability, privacy practices, pricing, or transactions.

Users access third-party services at their own discretion and should review the applicable terms and privacy policies.

At the time of publication of these Terms, standard professional listings are free.

EMS Atlas may introduce optional paid services, such as featured listings, enhanced profiles, or advertising opportunities.

Any paid service will be governed by clearly disclosed pricing and applicable additional terms before purchase.

EMS Atlas will not impose new recurring charges on an existing free account without obtaining the authorization required by applicable law.

Users may request account closure by contacting contact@theemsatlas.com or through available account settings.

EMS Atlas may suspend, restrict, or terminate accounts or listings for violations of these Terms, security concerns, fraudulent activity, legal requirements, or other legitimate operational reasons.

Where reasonably appropriate, EMS Atlas may provide notice and an opportunity to correct a violation.

Termination does not eliminate obligations or liabilities that arose before termination.

Personal information associated with closed accounts will be handled in accordance with our Privacy Policy and applicable law.

To the fullest extent permitted by applicable law, EMS Atlas provides the Platform on an "as is" and "as available" basis.

EMS Atlas disclaims warranties not expressly provided, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement, to the extent such disclaimers are legally permitted.

Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

To the fullest extent permitted by applicable law, EMS Atlas and its owners, officers, employees, and authorized representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Platform.

EMS Atlas is not responsible for the independent acts or omissions of listed professionals merely because those professionals appear in the directory.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud, willful misconduct, or other legally nonwaivable obligations.

Any additional limitations of direct monetary liability must be expressly stated in a legally reviewed provision appropriate to the applicable jurisdiction.

To the extent permitted by applicable law, professional users agree to indemnify and hold harmless EMS Atlas and its owners, officers, employees, and representatives against third-party claims, damages, liabilities, and reasonable legal expenses arising from:

• Their provision of EMS or other fitness services.
• Their material breach of these Terms.
• Their unlawful or misleading listing content.
• Their infringement of third-party intellectual property or other rights.
• Their negligent or wrongful conduct.

This obligation applies only to the extent the relevant claim is attributable to the professional user's conduct and does not require indemnification for EMS Atlas's own unlawful conduct or negligence where prohibited by law.

Personal information is collected, used, disclosed, retained, and protected as described in the EMS Atlas Privacy Policy.

By using the Platform, you acknowledge that you have been provided access to the Privacy Policy.

Where separate consent is legally required for particular data processing activities, EMS Atlas will seek that consent independently.

EMS Atlas may update these Terms to reflect changes in operations, features, legal requirements, or business practices.

The updated Terms will display a revised effective date.

Where required by law, users will receive additional notice or be asked to accept material changes.

Continued use after legally effective changes may constitute acceptance where permitted by applicable law.

Subject to mandatory consumer protection laws and other nonwaivable rights, these Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, disputes relating to these Terms will be brought before courts of competent jurisdiction in Los Angeles, California.

Nothing in this section deprives consumers of protections or rights to bring proceedings in another jurisdiction where such rights cannot lawfully be waived.
